Welcome to Klayons! These Terms of Service (“Terms”) govern your use of the Klayons website, mobile application, and services offered by BeFi Solutions Private Limited (“Klayons,” “we,” “us,” or “our”). Please read these Terms carefully before using our services.

By accessing or using Klayons services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

1. Definitions

“Services” refers to all services provided by Klayons, including but not limited to after-school activities, workshops, classes, and events organized within residential societies.

“User” refers to any individual who accesses or uses our Services, including parents, guardians, children, instructors, and society administrators.

“Account” refers to a registered user account on the Klayons platform.

“Content” refers to all information, text, images, data, links, software, or other material that Klayons displays or makes available through the Services.

2. Eligibility and Account Registration

To use certain features of our Services, you may need to register for an account. When you register, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your account credentials secure and confidential
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

Users under the age of 18 may only use our Services with the involvement and consent of a parent or legal guardian. Parents or guardians are responsible for supervising and ensuring their child’s compliance with these Terms.

3. Services and Enrollment

Klayons provides a platform that connects qualified instructors with children in residential societies/neighbourhood for various educational and extracurricular activities. By enrolling in our programs:

  • You acknowledge that availability is subject to minimum enrollment requirements
  • You agree to abide by specific program rules and requirements
  • You understand that schedules, instructors, and content may be subject to change
  • You agree to adhere to the Payment and Refund Policy (available at klayons.com/payment-refund-policy)

4. User Responsibilities

As a user of our Services, you agree to:

  • Comply with all applicable laws and regulations
  • Respect the rights and dignity of other users and instructors
  • Provide accurate and truthful information when using our Services
  • Not interfere with or disrupt the Services or servers
  • Not attempt to access accounts, systems, or data not intended for you
  • Not use our Services for any illegal or unauthorized purpose
  • Follow all guidelines and policies for specific programs

5. Prohibited Activities

You agree not to engage in any of the following activities:

  • Harassing, intimidating, or threatening any user or instructor
  • Posting or sharing inappropriate, offensive, or harmful content
  • Impersonating any person or entity
  • Using the Services to send unsolicited advertisements or spam
  • Introducing viruses, malware, or other harmful code
  • Attempting to reverse engineer, decompile, or disassemble any part of our Services
  • Using automated systems or software to extract data from our Services

6. Intellectual Property Rights

All content, features, and functionality available through our Services, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, and software, are owned by Klayons, our licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, reproduce, distribute, publish, transmit, or create derivative works of any material from our Services without our express written permission.

7. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using our Services, you consent to our collection and use of information as described in our Privacy Policy.

8. Termination

We reserve the right to terminate or suspend your account and access to our Services at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

You may terminate your account at any time by contacting us at support@klayons.com or deleting your account from the Klayons application. Upon termination, you will no longer have access to your account or any content or data associated with it.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KLAYONS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES.

Our total liability for any claims arising under these Terms shall not exceed the amount you have paid to Klayons in the past six months, or INR 5,000, whichever is less.

11. Indemnification

You agree to indemnify, defend, and hold Klayons, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) that arise from or relate to:

  • Your use of our Services
  • Your violation of these Terms
  • Your violation of any rights of another person or entity
  • Your breach of any representations or warranties made by you

12. Modifications to Terms

We reserve the right to modify or replace these Terms at any time. The most current version will be posted on our website. By continuing to use our Services after any changes, you accept the modified Terms.

For material changes, we will make reasonable efforts to provide notice, such as through a prominent notice on our website or by sending an email to the address associated with your account.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located in Haryana, India.
